Welcome to ONE! These Terms and Conditions (“Terms”) govern your use of our platform and services. By accessing or using ONE, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the ONE EDU platform, website, or related services (“Services”), you (“you,” “parent,” or “user”) agree to these Terms & Conditions and our Privacy Policy.
If you do not agree, you must not use the Services. If you are a parent or legal guardian, you agree to these Terms on behalf of your child.
2. Eligibility & Parental Responsibility
Children Under 13: Our Services are designed for children ages 8–13, and use by anyone under 13 requires verifiable parental consent.
Parental Account: A parent or guardian must create and manage the child’s account, provide consent, and supervise use of the Services.
Accuracy of Information: You agree to provide accurate, complete information during account creation and consent verification.
Parents are solely responsible for:
Monitoring their child’s use of the Services.
Ensuring the child follows safe online practices.
Managing parental controls and privacy settings.
3. Description of Services
ONE EDU provides:
Astra AI Mentor: A voice-interactive AI learning experience focused on entrepreneurship, emotional intelligence, financial literacy, and other life skills.
Child Dashboard: Personalized avatars, XP/skill progress tracking, and interactive quests.
Parent Dashboard: Consent controls, progress reports, and usage management.
We may update or modify the Services at any time to improve functionality, safety, and user experience.
4. User Accounts & Security
Account Creation: Parents must create accounts and provide consent for each child user.
Confidentiality: You are responsible for safeguarding your login credentials.
Unauthorized Access: Notify us immediately if you suspect unauthorized account activity. We are not responsible for losses arising from unauthorized use if caused by your failure to maintain account security.
5. Acceptable Use Policy
You agree not to:
Use the Services for any unlawful purpose or in violation of applicable laws.
Circumvent or disable security features.
Upload or transmit harmful content (malware, inappropriate materials, personal identifiers beyond those required for service).
Use automated systems to interfere with or disrupt Services.
Children are not permitted to submit personal information in conversations beyond what is necessary for learning experiences.
6. Intellectual Property
Ownership: All content, designs, AI prompts, code, learning modules, and trademarks are the property of ONE EDU LLC or its licensors.
Limited License: ONE EDU grants you a personal, non-transferable, non-exclusive, revocable license to use the Services solely for personal, non-commercial educational purposes.
Restrictions: You may not copy, distribute, modify, reverse-engineer, or create derivative works based on any part of the Services.
7. Content & User Submissions
Child-Generated Content: Children may create responses, voice recordings, or ideas within the platform. Such content remains the property of the child/parent, but you grant ONE EDU a non-exclusive, royalty-free, worldwide license to use this content solely to provide and improve the Services.
Prohibited Content: You must not upload or allow your child to upload offensive, illegal, or harmful content. ONE EDU may remove content and terminate accounts for violations.
8. Privacy & Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data in compliance with COPPA and other applicable laws. By using the Services, you consent to our data practices as described in the Privacy Policy.
9. Service Availability & Updates
We strive to keep the Services available and reliable but cannot guarantee uninterrupted access. We may suspend or modify Services for maintenance, safety, or technical reasons without liability.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement.
We do not guarantee that the Services will improve academic performance or guarantee specific learning outcomes.
11. Limitation of Liability
To the maximum extent permitted by law:
ONE EDU LLC and its affiliates, employees, and contractors shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.
In all cases, our total liability for claims relating to the Services will not exceed $100 or the amount paid by you in the past 12 months, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless ONE EDU LLC, its employees, and contractors from any claims, damages, or expenses (including attorney fees) arising from:
Your violation of these Terms.
Your or your child’s misuse of the Services.
13. Termination
ONE EDU may suspend or terminate your access if you:
Violate these Terms.
Provide false consent or account information.
Misuse or attempt to compromise platform security.
Parents may terminate their child’s account at any time through the Parent Dashboard or by contacting support@oneedu.ai.
14. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Dispute Resolution:
Any dispute must first be attempted to be resolved informally by contacting support@oneedu.ai.
If unresolved, disputes shall be submitted to binding arbitration in St. Petersburg, Florida, under the rules of the American Arbitration Association.
Class actions are not permitted, and disputes will be resolved on an individual basis only.
15. Changes to These Terms
We may update these Terms as our Services evolve. Material changes will be communicated to the parent email on file and will take effect after notification. Continued use of the Services constitutes acceptance of updated Terms.
